E.O. 11246 defines Affirmative Action as: "applicants are employed...without regard [emphasis added] to their race, color, religion, sex, sexual orientation, gender identity, or national origin." SCOTUS just struck down college admissions practices that are not real Affirmative Action because college practices (before this SCOTUS ruling) have violated this definition by making decisions based upon race overriding other factors like actual academic preparedness.
