Without a law of war, you get parties baking and beheading babies with no moral code to say that's wrong. You may think the law of war is still too permissive, which is what you actually seem to think, but then your proper response would be to go in the opposite direction: to make the law of war more restrictive. So, your response isn't really even coherent.
